You acknowledge and agree that AR-KABUY shall not be liable for any communication failures, interruptions, errors, distortions, or delays you may experience when using the services, however caused.
Under no circumstances shall AR-KABUY, its affiliates and service providers, or any of their respective directors, officers, agents, employees, advisors, consultants, or representatives be liable: (a) for an amount greater than the total fees paid by you for the service that is the subject of the cause of action in the twelve (12) months preceding the event giving rise to the loss; or (b) for any loss of profits, decrease in business value or opportunity, any loss, damage, corruption or breach of data or other intangible property, or any special, incidental, indirect, intangible or consequential damages, whether based on contract, tort, negligence, strict liability, or otherwise, arising out of or in connection with the authorized or unauthorized use of the site or the services, or this agreement, even if an authorized representative of AR-KABUY has been advised of or knew or should have known of the possibility of such damages, and notwithstanding the failure of any agreed or other remedy of its essential purpose, except to the extent of a final judicial determination that such damages were the result of gross negligence, fraud, willful misconduct, or intentional violation of law.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you. We do not control or own the underlying software protocols that govern the operation of Digital Assets. These protocols are typically open source, which means anyone can use, copy, modify, and distribute them.
We assume no responsibility for the operation of such underlying protocols and cannot guarantee the functionality or security of network operations.
Specifically, these protocols may be subject to sudden changes in their operating rules, including "forks." Such operational changes may significantly affect the availability, value, functionality, and/or name of the corresponding digital currency. AR-KABUY has no control over the timing or characteristics of such significant operational changes. It is your responsibility to stay informed about upcoming operational changes and to carefully consider publicly available information and that provided by AR-KABUY to determine whether to continue using our services.
We will make reasonable efforts to notify you of our response to any significant operational changes; however, such changes are beyond our control and may occur without prior notice to AR-KABUY.
You acknowledge and agree to the risks associated with operational changes to Digital Asset protocols and understand that AR-KABUY is not responsible for such changes or for any loss of value you may experience as a result.
You further acknowledge that AR-KABUY has sole discretion in determining its response to any operational change and that we are under no obligation to assist you with incompatible coins or protocols. By using our Services, you may access content or use services provided by third parties, including hyperlinks to third-party websites and services from such parties (“Third-Party Content”). We do not endorse, adopt, or control any Third-Party Content and assume no responsibility for such content. Any dealings or correspondence you have with such third parties are solely between you and the third parties.
